These Terms of Service ("Terms") govern your access to and use of the website, booking services, travel-related services and related communications provided under the HISIGHTS brand.
HISIGHTS is operated by HONG KONG HI TANSFERS LIMITED, a company registered in Hong Kong, with its registered address at Room S-V18, 6/F, Vanta Industrial Centre, 2-12 Au Pui Wan Street, Fo Tan, Hong Kong ("HISIGHTS", "we", "us" or "our").
By accessing our website, submitting an enquiry, making a booking, making payment, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our website or services.
1. Our Services
HISIGHTS provides and arranges travel-related services, including but not limited to:
- airport transfers;
- private chauffeur services;
- hourly car charter services;
- city-to-city transfers;
- private ground transportation;
- destination arrangements;
- customized travel planning;
- local experiences, guides, interpreters, consultants and concierge-style support;
- other travel-related services agreed with you in writing.
Some services may be provided directly by us. Other services may be fulfilled by independent drivers, vehicle operators, guides, local agencies, hotels, venues, restaurants, ticketing providers, licensed travel agents or other third-party suppliers ("Service Partners").
Where any service is required by applicable law to be provided by a licensed person or licensed entity, such service will be provided directly by us where we hold the appropriate licence, or arranged through an appropriately licensed Service Partner.
Your booking confirmation, quotation, itinerary, invoice, voucher, email or written message may contain additional service-specific terms. If there is any conflict between these Terms and the service-specific terms, the service-specific terms will apply to that specific booking.
2. Eligibility and Use of the Website
You may use our website and services only for lawful purposes.
By using our website or making a booking, you confirm that:
- you are at least 18 years old, or you are using our services under the supervision of a parent, guardian or authorized representative;
- all information you provide is true, accurate and complete;
- you have authority to make the booking on behalf of all travellers included in the booking;
- all travellers included in the booking agree to comply with these Terms and any service-specific requirements.
You must not use our website or services for fraudulent, illegal, abusive, harmful or unauthorized purposes.
3. Enquiries, Quotations and Bookings
A service enquiry does not create a confirmed booking.
A booking is only confirmed when:
1. we have accepted your booking request;
2. the required payment, deposit or written payment arrangement has been completed; and
3. we have issued a written confirmation by email, website message, instant message, invoice, voucher or other written communication.
All quotations are subject to availability and may change until the booking is confirmed.
Unless expressly stated otherwise, quotations may exclude parking fees, tolls, fuel surcharges, overtime, additional stops, attraction tickets, meals, accommodation, guide fees, personal expenses, local taxes, government charges, bank charges and other third-party costs.
4. Prices, Currency and Payment
Prices may be shown in USD, HKD, CNY or other currencies supported by us.
The final payable amount may vary due to currency conversion, payment processor fees, bank fees, foreign exchange rates, card issuer charges or local taxes. We are not responsible for fees charged by your bank, card issuer, payment provider or other financial institution.
We may require full payment, partial payment or a deposit before confirming a booking.
If payment is not received by the stated deadline, we may cancel the booking without further notice.
You agree not to make any false, unauthorized or fraudulent payment. If a chargeback, payment dispute or reversal is initiated, we may suspend or cancel the relevant booking and recover any unpaid amount, bank fees, payment processing fees, administrative costs and other reasonable losses caused by the dispute.
5. Changes by You
If you wish to change a confirmed booking, you must contact us as soon as possible.
Requested changes may include changes to date, time, pick-up location, drop-off location, itinerary, vehicle type, passenger number, luggage quantity, flight or train information, service duration or special requirements.
Changes are subject to availability and may result in additional charges. We are not obliged to accept a change request after a booking has been confirmed.
For transportation services, any additional waiting time, overtime, route change, unscheduled stop, parking fee, toll, entrance restriction, special access fee or other additional cost may be charged separately.
6. Cancellation and Refunds
The applicable cancellation and refund policy may be stated in the booking confirmation, quotation, invoice, service-specific terms or a separate Cancellation and Refund Policy.
Unless otherwise stated in writing:
- cancellations made more than 72 hours before the scheduled service time may be eligible for a partial refund after deduction of non-refundable costs and payment processing fees;
- cancellations made within 72 hours of the scheduled service time may be non-refundable;
- no-shows are non-refundable;
- bookings involving special arrangements, peak season services, customized itineraries, advance ticketing, hotel bookings, event access, licensed guides, interpreters, multi-day arrangements or third-party supplier commitments may be partially or fully non-refundable.
Refunds, if approved, will usually be returned to the original payment method. Bank fees, card fees, foreign exchange differences, payment processor charges and third-party costs may not be refundable.
Processing time for refunds may vary depending on the payment provider, bank or card issuer.
7. No-Show, Waiting Time and Delays
You are responsible for being present at the agreed pick-up point at the agreed time.
Unless otherwise stated in the booking confirmation:
- airport arrival pick-ups include up to 60 minutes of waiting time from the actual flight landing time;
- train station or ferry terminal pick-ups include up to 30 minutes of waiting time from the actual arrival time;
- hotel, address or other point-to-point pick-ups include up to 15 minutes of waiting time from the scheduled pick-up time.
Additional waiting time is subject to driver and vehicle availability and may be charged separately.
If you cannot be contacted, fail to appear, provide incorrect information, or arrive after the included waiting time, the booking may be treated as a no-show and no refund will be provided.
We will make reasonable efforts to monitor flight or train delays where relevant information is provided, but we are not responsible for delays, missed connections, missed flights, missed trains, denied boarding or other loss caused by inaccurate, incomplete or late information provided by you.
8. Vehicles, Luggage and Passenger Capacity
Vehicle images shown on the website are for reference only. The actual vehicle may vary depending on location, availability, operating conditions and local supplier arrangements.
You must provide accurate passenger and luggage information before confirmation. We may refuse service or require a vehicle upgrade if the passenger number or luggage quantity exceeds the safe or legal capacity of the arranged vehicle.
Passengers must comply with local laws, vehicle safety rules and reasonable instructions from the driver or service provider. Seat belts must be worn where required by law.
Smoking, illegal substances, dangerous items, abusive behaviour, harassment, damage to the vehicle, or conduct that threatens safety may result in immediate termination of service without refund.
You are responsible for any cleaning fee, repair cost, damage, fine, penalty or loss caused by you or any traveller in your group.
9. Travel Documents, Visas and Personal Responsibilities
You are responsible for ensuring that you and all travellers in your group have valid passports, visas, permits, entry approvals, health documents, travel insurance and any other documents required for the journey.
We may provide general travel information, but such information is for convenience only and should not be treated as legal, immigration, medical or official government advice.
We are not responsible for any loss, delay, denial of entry, cancellation, additional cost or other consequence arising from your failure to obtain or carry valid travel documents or comply with applicable laws and regulations.
We strongly recommend that all travellers obtain appropriate travel insurance covering medical issues, accident, cancellation, delay, personal belongings and other travel risks.
10. Third-Party Suppliers and Local Conditions
Some services are provided by third-party Service Partners. These Service Partners may have their own terms, rules, safety requirements, cancellation policies and liability limitations.
By making a booking, you agree to comply with the applicable terms and instructions of the relevant Service Partners.
We use reasonable care in selecting and coordinating Service Partners, but we are not responsible for acts, omissions, delays, defaults, accidents, injuries, losses or failures caused by third-party suppliers, government authorities, transport operators, hotels, venues, restaurants, attractions, event organizers or other independent parties, except to the extent required by applicable law.
Travel services may be affected by traffic, weather, road conditions, border control, security checks, government restrictions, public events, strikes, accidents, natural disasters, local regulations or other circumstances beyond our reasonable control.
11. Service Availability and Substitution
All services are subject to availability.
We may substitute a vehicle, driver, guide, route, supplier or arrangement with a reasonably comparable alternative where necessary due to availability, safety, operational, legal or force majeure reasons.
If a material part of the service becomes unavailable, we will make reasonable efforts to offer an alternative arrangement or appropriate refund where applicable.
12. User Content and Reviews
If you submit reviews, comments, photos, videos, feedback, suggestions or other content to us, you confirm that you have the right to provide such content and that it does not infringe any third-party rights or violate any law.
You grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, publish, translate, edit and display such content for business, marketing, service improvement and customer support purposes, unless you expressly notify us otherwise in writing.
We may remove or refuse to publish any content that is unlawful, misleading, abusive, offensive, defamatory, discriminatory, private, confidential or otherwise inappropriate.
13. Intellectual Property
All website content, design, text, images, graphics, logos, icons, software, service descriptions, itineraries, brand names and other materials are owned by us or licensed to us, unless otherwise stated.
You may not copy, reproduce, modify, distribute, sell, scrape, reverse engineer, frame, mirror or commercially exploit any part of our website or content without our prior written consent.
The HISIGHTS name, brand identity and related materials may not be used without our prior written permission.
14. Website Information
We try to keep the website accurate and up to date, but we do not guarantee that all information is complete, current or error-free at all times.
Website content is provided for general information and booking purposes only. Service availability, prices, descriptions, operating hours, travel times, routes and local conditions may change without prior notice.
We may update, suspend or discontinue any part of the website or service at any time.
15. Privacy and Personal Data
We collect, use and process personal data for purposes including handling enquiries, confirming bookings, arranging services, processing payments, communicating with you, customer support, safety, compliance, fraud prevention and service improvement.
Your personal data may be shared with Service Partners, payment processors, technology providers, professional advisers, government authorities or other parties where reasonably necessary for the provision of services, compliance with law, protection of rights, or other legitimate business purposes.
Our handling of personal data is also governed by our Privacy Policy. If there is any inconsistency between these Terms and our Privacy Policy in relation to personal data, the Privacy Policy will apply to the extent of that inconsistency.
You should not provide personal data of other travellers unless you have their authorization to do so.
16. Electronic Communications
You agree that we may communicate with you by email, website message, SMS, phone call, instant messaging application or other electronic means using the contact details you provide.
You are responsible for checking messages from us and ensuring that your contact details are accurate and reachable before and during the service period.
Important service information may be sent electronically, including booking confirmations, payment requests, driver details, meeting point information, itinerary updates, emergency messages and cancellation notices.
17. Prohibited Conduct
You must not:
- use the website or services for unlawful, fraudulent or harmful purposes;
- provide false, misleading or incomplete information;
- interfere with website security or operation;
- attempt unauthorized access to our systems;
- use bots, scraping tools or automated systems without permission;
- resell our services without authorization;
- abuse, threaten, harass or discriminate against our staff, drivers, guides, Service Partners or other customers;
- carry illegal, dangerous, hazardous or prohibited items;
- use our services in a way that creates safety, legal or reputational risk.
We may refuse, suspend or terminate service without refund if you breach these Terms or create a risk to safety, legality or service operation.
18. Disclaimers
To the fullest extent permitted by applicable law, our website and services are provided on an "as available" basis.
We do not guarantee that:
- the website will be uninterrupted, secure or error-free;
- all travel times, arrival times or transfer durations will be exact;
- third-party suppliers will always perform without delay or disruption;
- local attractions, restaurants, hotels, roads, venues or activities will be available at all times;
- travel information will remain unchanged after publication or communication.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
19. Limitation of Liability
To the fullest extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, punitive or exemplary damages, including loss of profit, loss of business, loss of enjoyment, loss of opportunity, loss of data, missed flights, missed trains, missed events, missed meetings or other indirect losses.
To the fullest extent permitted by applicable law, our total liability in connection with a confirmed booking shall not exceed the amount actually paid by you to us for the affected service.
Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.
Any limitation or exclusion of liability in these Terms shall apply only to the extent permitted by the laws of Hong Kong and any other applicable mandatory law.
20. Indemnity
You agree to indemnify and hold harmless HISIGHTS, HONG KONG HI TANSFERS LIMITED, our directors, employees, contractors, agents and Service Partners from and against any claims, losses, liabilities, damages, fines, penalties, costs and expenses arising from:
- your breach of these Terms;
- inaccurate or incomplete information provided by you;
- your unlawful, negligent or abusive conduct;
- damage caused by you or any traveller in your group;
- your failure to comply with laws, regulations, travel requirements or supplier rules;
- claims made by travellers or third parties on whose behalf you made a booking.
21. Force Majeure
We will not be liable for any failure, delay, cancellation, change or loss caused by events beyond our reasonable control, including but not limited to:
- extreme weather;
- natural disasters;
- epidemic, pandemic or public health measures;
- war, terrorism, civil unrest or public disorder;
- government restrictions or border control;
- strikes or labour disputes;
- traffic accidents, road closures or transport disruption;
- power, internet, platform or system failures;
- supplier failure beyond our reasonable control;
- any other event that makes performance impossible, unsafe, unlawful or commercially impracticable.
In such circumstances, we may offer alternative arrangements, credit, partial refund or other solution at our reasonable discretion, subject to supplier policies and costs already incurred.
22. Complaints and Customer Support
If you experience a problem during a service, you should contact us as soon as reasonably possible so that we may try to assist or resolve the issue.
Complaints submitted after completion of the service should be made in writing within 7 days, with relevant booking details, photos, receipts or supporting information.
We will review complaints in good faith, but compensation or refund is not guaranteed unless required by law or agreed by us in writing.
23. Suspension and Termination
We may suspend or terminate your access to our website or services if we reasonably believe that you have breached these Terms, violated any law, created a safety risk, engaged in fraud or abuse, or harmed our business, staff, Service Partners or other customers.
Termination does not affect any rights, obligations, payment obligations, liability limitations or dispute provisions that should reasonably survive termination.
24. Changes to These Terms
We may update these Terms from time to time.
The latest version will be posted on our website with the updated date. Continued use of our website or services after the updated Terms are posted constitutes acceptance of the updated Terms.
For confirmed bookings, the Terms in effect at the time of booking will generally apply, unless changes are required by law or agreed with you in writing.
25. Governing Law and Jurisdiction
These Terms and any dispute or claim arising out of or in connection with them, the website, any booking or any service shall be governed by and interpreted in accordance with the laws of Hong Kong.
The courts of Hong Kong shall have non-exclusive jurisdiction over any dispute arising out of or in connection with these Terms, the website, any booking or any service.
